Terms of Service

These Terms of Service (“Terms”) govern your use of Occasio — our mobile application, recipient web pages, and related services (the “Service”), operated by Nick Kubde (“we”, “us”, “our”) from India.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Occasio. We ask for your date of birth when you first open the app and again when an account is created; we do not store it. If you are under 13 you may not use the Service or create an account, and we delete any account we learn belongs to someone under 13. If you are under 18, you should use the Service with a parent or guardian’s permission.

2. The Service

Occasio helps you create and share personalized digital greeting cards and, when available, save people and dates for reminders or automatic sending.

Features may change over time. We may add, modify, or remove features without notice. Some features require an account or a paid subscription.

Guest use: you may create and share cards without signing in, subject to usage limits described in the app.

Recipients: people who receive a share link can view the card in a browser without creating an account. Links are time-limited as described in our Privacy Policy.

3. Your account

If you create an account, you are responsible for:

• Providing accurate information
• Keeping your sign-in credentials secure
• All activity under your account

You may sign out or request account deletion at any time. See Delete your account and data and our Privacy Policy.

4. Your content

You retain ownership of photos, messages, and other content you submit (“Your Content”).

By submitting Your Content, you grant us a limited, non-exclusive license to host, process, display, and transmit it only as needed to operate the Service — for example, to generate a share link, show the card to recipients, or deliver auto-send when you enable it.

You represent that:

• You own Your Content or have permission to use it
• Your Content does not violate any law or third-party rights
• You have a lawful basis to provide information about other people you add to your Vault (names, dates, contact details)

We may remove content that violates these Terms or applicable law, or that we reasonably believe is harmful, abusive, or fraudulent.

Copyright. Only upload photos, text and other material you own or have permission to use. If you believe a card infringes your copyright, follow the procedure in our Copyright and DMCA policy. We respond to valid notices by disabling the card, we accept counter-notices, and we terminate the accounts of repeat infringers. Anyone who receives a card can report it with the Report this card link at the bottom of the card.

5. Acceptable use

You agree not to:

• Use the Service for harassment, spam, or illegal activity
• Impersonate others or misrepresent your relationship to recipients
• Upload malware, abusive imagery, or content that exploits minors
• Attempt to bypass security, scrape the Service, or abuse share links
• Resell or commercially exploit the Service without our written consent

We may suspend or terminate access for violations.

6. Subscriptions and payments

Paid plans (when offered) are billed through Google Play or the Apple App Store. Prices, billing cycles, and features are shown in the app at purchase.

• Subscriptions renew automatically at the same price and interval until you cancel. Cancel before the renewal date, either in the app (Account → Cancel or manage subscription, no email needed) or in your store account settings. We email a confirmation when you subscribe that repeats these terms.
• Refunds are handled according to Google Play or Apple policies; we do not control store refund decisions.
• Free tiers and promotional offers may have limits (e.g. number of saved people, watermarks, link expiry).

Cancel any time, in the app or in your device’s subscription settings. Deleting the app does not cancel a subscription. After you cancel you keep access until the end of the period you paid for.

7. Share links and delivery

Share links are unlisted — anyone with the URL may view the card until it expires. You are responsible for who you share links with.

We strive for reliable delivery of cards and future auto-send features, but we do not guarantee that every message will be delivered on a specific date or channel (WhatsApp, SMS, email, etc.). Network and third-party provider issues may cause delays or failures.

8. Intellectual property

Occasio’s name, logo, templates, software, and design are our property or our licensors’. These Terms do not grant you rights to our branding except as needed to use the Service.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ₹1,000.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service.

Sections that by nature should survive (including disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

13. Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Material changes may also be communicated in the app where appropriate. Continued use after changes constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction over disputes arising from these Terms or the Service, except where mandatory consumer protection laws in your country give you non-waivable rights.
